ACCOUNT WAGERING TERMS AND CONDITIONS
These Terms and Conditions cover the use of the pari-mutuel wagering account established by you with us for Account Wagering and for Telephone/Internet account wagering in respect to our automated telephone account pari-mutuel wagering system and/or the Account Devices located on track and/or the use of customer owned internet connected devices on the WEG provided Wi-Fi networks and Champions Teletheatre locations (the “Account”). Such use is subject to and conditional upon compliance by you with these Terms and Conditions and the provisions of sections 76 – 84 of the Pari-Mutuel Betting Supervision Regulations of the Canadian Pari-Mutuel Agency ("CPMA"). By completing and returning the Account application you agree to accept and be bound by these Terms and Conditions.
For purposes of this Agreement, "you" and "your" means the Account holder named in the Account application; and "we", "us" and "our" means Woodbine Entertainment Group (“WEG”) and/or HPIbet.com.
1. QUALIFYING FOR A WAGERING ACCOUNT:
In order to qualify for an Account, you confirm that you are a person 18 (19 in B.C.) years or older, who either: (i) resides in our Home Market Area, as established from time to time by your Provincial Racing Commission, or (ii) is a resident of the Northwest, Yukon or Nunavut Territories.
2. ACCOUNT HOLDER RESPONSIBILITIES:
You agree to use the Account in accordance with the instructions and conditions in these Terms and Conditions, or as otherwise communicated to you from time to time by us.
You authorize us to accept, and you agree to be responsible for, all instructions sent to us, including to our totalisator system (the "WEG Tote System"), by such means as are made available by us, when accompanied by your Username, Password and personal identification number (PIN) (collectively, your "HPIbet credentials.")
The Account is for your personal use only. Any wager placed by a person other than you is strictly prohibited and will result in the immediate termination of your Account. You are legally responsible for all wagering placed through your Account using your HPIbet credentials, whether by you or any other person with or without your knowledge or consent, until notification has been received by WEG confirming cancellation of your Account, or that the confidentiality of your HPIbet credentials has been compromised. You bear full responsibility for maintaining the confidentiality of your Account, including your HPIbet credentials and must do so.
You may only claim rewards/bonuses/points or other promotional offers by WEG (“Offers”) that are earned by wagers placed by you through your Account. You may not collect Offers related to the wagering activity of third parties.
Use of HPIbet.com is for use of placing bets only, in accordance with these Terms and Conditions. WEG is not responsible for any equipment not within its control. The risk of a technical corruption of an Account holder’s wager is on the Account holder.
3. DEPOSITS AND WITHDRAWALS:
A deposit of money to your Account can be made by you. Deposits can be made by presenting in person, at the HPIbet Player Services booth, cash, credit card, debit card, money order, certified or uncertified cheque along with a deposit slip bearing your account number. In the case of uncertified cheques, your Account will only be credited with funds after our bank has cleared those funds. The cheque clearing process will take 15 business days on average.
We will permit credit card-cash advances made by you to be credited to your Account.
In compliance with Visa/Mastercard rules, if you use a credit card directly or through PayPal to fund your HPIbet account, Visa and Mastercard will treat the transaction as a cash advance and certain fees and interest charges may apply. Please contact your credit card issuer for further details. HPIbet does not charge any fees for account deposits, and these charges do not apply to Interac Online.
For any Visa/Mastercard Debit transactions that have been refunded or if there is a disruption in communication with your financial institution, the funds can be held up to 3-5 business days by your financial institution.
All Visa and MasterCard cash advances are subjected to a verification process before funds are deposited to your HPIbet account. To pass this process please verify that your HPIbet profile information and your credit card profile information are both up-to-date. If you are making your first Credit Card or Visa/Mastercard debit deposit, you may be asked for additional verification including photo I.D.
Visa and MasterCard Gift Cards are also permitted as a method of funding your account online; however, not all are guaranteed to pass the verification process. For details regarding using your gift card for account funding purposes, please contact the issuing financial institution of the card.
Withdrawals from your Account can be made by you in person, with valid photo identification and a signed withdrawal slip, during regular operating hours at the HPIbet Player Services booth. A withdrawal request can also be made by contacting the HPIbet Support Centre via phone and speaking with a live representative. A withdrawal request may also be made in writing including your account number and signature, by mail or fax, when submitted to the HPIbet Support Centre, in which case we will honour such request within 48 hours of our receipt, via regular mail to the address on file or for pickup with valid photo identification at the HPIbet Support Centre.
You will not be permitted, under any circumstances, to establish a negative balance or overdraft in your Account. (Vouchers over $1,000 may not be cashed at Champions Teletheatres)
4. CONVERSION OF FOREIGN CURRENCIES:
Funds may be deposited in Canadian or US funds. US funds will be converted to Canadian funds, at the then current daily conversion rate. All other currencies besides US will be converted to Canadian currency. We will use the posted exchange rate as set by The Bank of Canada at the time the conversion is effected and the deposit is made.
5. ACCOUNT BALANCES DO NOT EARN INTEREST:
Moneys on deposit in your Account will not bear any interest to you.
6. WAGER CANCELLATIONS:
You may cancel wagers placed through your account on HPIbet.com, prior to post time, under the My Transaction section. To cancel a wager placed through the telephone please contact an HPIbet representative at 416-675-8826 or 1-888-675-8886. Every effort will be made to process cancellations prior to post time; however, we cannot guarantee cancellations close to post time. Please allow sufficient time when calling to wager cancellations.
7. RECORDS AND CLAIMS:
Account Statements can be provided upon written request. Requests are limited to a rolling 6 month window of availability of data. Please send your request to HPIbet Support Centre, 555 Rexdale Boulevard P.O. Box 156, Toronto Ontario Canada M9W 5L2.
Any claims by you that your Account balance is incorrect must be made in writing or email to the HPIbet Support Centre (email@example.com) within fifteen (15) business days of receipt of an Account Statement.
8. ACCOUNTS MAY BE CLOSED BY US:
We reserve the sole and exclusive right to close your Account for any reason whatsoever, by returning the balance of any funds in your Account to you together with a closing Account Statement. Unauthorized or fraudulent use of the Account will result in immediate termination thereof, and may be punishable by law.
9. OFFER TO WAGER TERMS AND CONDITIONS:
All offers to wager made by us to you, are made subject to these Terms and Conditions, including without limitation, the following specific Terms and Conditions:
- all Account information, including your HPIbet credentials, entered on the System being correct;
- the wager placed meets the minimum betting amount as per the host track and CPMA requirements;
- sufficient funds to place the wager being available in your Account;
- the notice of acceptance of the offer to wager being received at the WEG Tote System;
- the WEG Tote System not having closed its pari-mutuel pool for wagering on the race in respect of which the wager is placed, at the time notice of acceptance of the offer to wager is received at the WEG Tote System.
10. RECORDING OF WAGERS:
You hereby consent to the recording of all Account transactions and calls by WEG and/or HPIbet and the CPMA’s monitoring of the said transactions and calls. The CPMA can be contacted respecting any regulatory concerns to your Account by calling toll free at 1-800-268-8835.
11. LIMITATION OF LIABILITY:
EXCEPT AS EXPRESSLY STATED HEREIN, WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE OPERATION OF THE HPIBET WAGERING ACCOUNT, INCLUDING YOUR ABILITY TO EFFECTIVELY WAGER VIA THE HPIBET SYSTEM. WITHOUT IN ANY WAY LIMITING THE FOREGOING, ALL IMPLIED WARRANTIES FOR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. You acknowledge that you have read this paragraph, agree that it has been specifically NEGOTIATED and agree that this paragraph is an integral part of the Terms and Conditions of your agreement with us. For certainty, in no event shall we be liable to you for any losses or damages incurred by you or any other party resulting from your establishment or use of the HPIbet wagering Account, except that resulting from our gross negligence or fraud, and including without limitation ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OR ANY LOSS OF PROFITS. IN NO EVENT SHALL OUR LIABILITY FOR ANY CLAIM EXCEED THE COST OF YOUR WAGER AND YOU AND WE AGREE THAT SUCH AMOUNT IS A GENUINE PRE-ESTIMATE OF ANY LOSS OR DAMAGE WHICH MAY BE INCURRED, ARISING FROM ANY CAUSE WHATSOEVER.
You agree to indemnify and hold harmless us and our directors, officers, employees and agents, from all claims, liabilities, losses or damages whatsoever incurred, arising from or by reason of your failure to comply with these Terms and Conditions.
13. ACCOUNT PURCHASE TERMS & CONDITIONS:
You understand and agree that all program information acquired is for your personal use. All program information acquired is provided for use in an online or hardcopy print environment. You agree that you will not download program information acquired with the intent to database it for future use. WEG at its sole discretion, will determine if user activity patterns indicate that information is being used for purposes other than handicapping in an online or hardcopy print environment. If WEG determines that program information is being used for purposes other than handicapping in an online or hardcopy print environment, WEG will close any such Accounts.
Refund policy for Past Performance program sales. In the event that a track cancels its racing any time before the 6th race running, a refund for the full purchase price of the canceled card will be granted. Refunds will be applied directly to your HPIbet wagering Account by the next business day after the cancellation date. All purchase refunds will be credited back as a single cash deposit directly into your HPIbet Account.
Your purchase of the Past Performance program(s) indicates your acceptance of these Terms and Conditions of use as stated above. All charges to your account shall be denominated in Canadian currency.
The Streaming Centre is available for free to all HPIbet members, once your wagering meets the following criteria: A minimum of $50 during the last 5 calendar days, or a minimum of $100 wagered during the previous 30 calendar days, or a minimum of $600 wagered during the previous 90 calendar days, or a minimum of $5,000 during the previous 365 calendar days. If your wagering does not meet the criteria to access The Streaming Centre, you can purchase a daily subscription for $5 CND or 1600 points as well as a monthly subscription for $20 CND or 6200 points. Once the above requirements are met your HPIbet account will then be automatically updated the next day (24hrs) and all tracks will be available for viewing. All HPIbet wagers (on-track, phone, internet, and teletheatres) qualify towards these requirements.
14. RIGHT TO CHANGE TERMS AND CONDITIONS:
We reserve the right to make changes to these Terms and Conditions or any of them at our sole discretion at any time and from time to time, with any such changes taking effect immediately. Your continued use of the Account constitutes acceptance of such amended Terms and Conditions.
15. REWARDS PROGRAMS
HPIbet may offer rewards programs with respect to such markets and upon such terms and conditions as may be determined by WEG and/or HPIbet from time to time. We reserve the right to cancel or amend any such rewards programs at our sole discretion at any time and from time to time, with any such termination or changes taking effect immediately. Your continued use of the Account constitutes acceptance of any terms and conditions applicable to such rewards programs.
16. PARTIAL CASH OUT (“PCO”):
The PCO option is available in select markets and only on participating multileg pools, as determined by us from time to time in our sole discretion. The availability of the PCO option is not guaranteed with respect to any Wager. Should PCO be available with respect to your Wager, a message will appear enabling you to choose to accept the PCO option. Should you choose to accept the PCO option, then PCO offer(s) may be made to you during the course of the Wager. By selecting the PCO option, you are deemed to accept these Terms & Conditions.
PCO offers will not be available prior to the start of the first race with respect to any Wager. Although you may have elected to participate in the PCO offering, there is no guarantee or assurance that you will receive an offer. A PCO offer is subject to a time delay; price changes or other issues arising during this time may result in a new PCO offer being made, or in the suspension or removal of an existing, un-expired PCO offer on that Wager at that time. All PCO offers are inclusive of the original amount staked.
At no time are you obligated to accept any PCO offer. Any and all PCO offers may be declined by you during the course of the Wager. You may accept PCO offers for all or any portion of the Wager at your sole discretion, depending on the nature of the PCO offer. No PCO offer may be accepted after it has expired. PCO offers, if accepted, must be completed by you personally; in no event may a PCO transaction be facilitated by an agent on your behalf.
A PCO offer relates to all or a portion of the value of the applicable Wager. Regardless of the amount of any PCO transaction, at no time do we assume ownership of any Wager or any ticket associated therewith. We simply facilitate the offers from a 3rd party.
You bear the sole responsibility for ensuring that your acceptance of any PCO offer is valid and correct. You authorize us to accept, and you agree to be responsible for, any acceptance of PCO offers using your HPIbet account. PCO offers are non-negotiable and PCO offer acceptance is final and may not be cancelled by you. Once an accepted PCO offer is processed, the portion of the Wager to which the PCO offer applies is settled and deemed final. The actual final result(s) of the remaining race(s) will have no impact on the accepted PCO amount. You will be entitled to participate in a proportionate amount of any payout which may apply to any remaining portion of the Wager retained by you at the resolution of the final race to which the Wager applies.
Wagers that qualify for bonuses or enhancements will not have the bonus or enhancement applied in addition to the PCO offer.
If a PCO offer is accepted by you in full or in part, the amount that was cashed out will be officially credited to your account for use once the prices and results for the Wager are official, or sooner at our discretion. In the event that, for any reason whatsoever, (i) the Wager is cancelled or refunded, or (ii) the PCO offer is cancelled, then the PCO offer, whether at the offer stage or accepted in whole or in part, shall become null and void. In the event of an error in our pricing, any affected PCO offer may not be cashed out; in this event, the PCO offer will be cancelled and the original Wager will be settled on the final result with the correct prices applied to the Wager. If a PCO offer has been extended in error, then the PCO offer will be cancelled and the original Wager will be settled on the final result with the correct prices applied to the Wager. Where an error results in an incorrect amount being offered that is subsequently cashed out, then the PCO transaction will be made void and the original Wager will be settled on the final result with the correct prices applied to the Wager. If further attempts are made to place bets or accept PCO offers on races that are affected by an error before the error is corrected, we reserve the right at our sole discretion to void the cashed out amount and cancel any such Wager.
Where we have reason to believe that a PCO transaction has been carried out after the outcome of a race or series of races is known, we reserve the right at our sole discretion to void the cashed out amount and cancel the Wager, or void the PCO transaction and settle the original Wager on the final result with the correct prices applied to the Wager.
In the event of any disagreement regarding a PCO transaction, we will refer to our records of the transaction and base our subsequent decision on this information.
We provide no guarantee, and shall not be liable for any losses accrued as a result of any unavailability of the PCO facility (including but not limited to resulting from any technical issues). All Wagers will stand regardless of the availability of the PCO facility. We accept no responsibility for any customer inability to utilize the PCO facility for any reason. Wagers will stand as originally placed during any period of PCO unavailability.
We reserve the right to amend, suspend or remove PCO availability at any time, on any race(s), for any customer and for any reason. We reserve the right to amend these PCO Terms & Conditions at any time without notice to you. Your continued use of the Account constitutes acceptance of such amended PCO Terms and Conditions.
